CredCheck Pro, owned by Proprietor Ishit Karoli (hereinafter referred to as “Us,” “We,” or “Our”), has established this Data Protection and Privacy Policy (hereinafter “Policy”) for its product CredCheck Pro. This document outlines our practices concerning the collection, use, and disclosure of Personal Information obtained from users of CredCheck Pro and related services (referred to as the “Platform”). Please review the entire Policy carefully, as it constitutes a contractual agreement between the Customer or Candidate and Us, depending on the context and usage of Services.

This policy is applicable when you utilize CredCheck Pro and related services as a Customer or as a Candidate.

By accessing CredCheck Pro and related services and the Platform, you consent to the collection and use of information as outlined in this policy. If you have any uncertainties about the applicable standards or if you have comments or questions about this Policy, please reach out to us using the contact details provided in this Policy.

You retain various rights and standards related to the usage and processing of your data when you use CredCheck Pro, and these rights are detailed in this policy. You have the option to exercise these rights. However, it’s important to understand that while exercising certain rights under this policy, you may limit the processing of information necessary to provide you with the services, either in part or in full.

2. APPLICABILITY

This policy is relevant to:

• All customers who choose and pay for background verification services accessible on the CredCheck Pro platform.
• All candidates subject to background verification/check.
• All individuals visiting the CredCheck Pro website.

3. THE INFORMATION WE COLLECT

We require various types of information based on the services requested by the Customer to conduct background verification/check. This information serves to identify you as an individual and is classified as “Personal Information.” Depending on the type of background verification requested by the Customer, CredCheck Pro may collect the following information:

Personal Identifier Information:

• Name, date of birth, phone number, email address, residential address.
• Government-issued identification documents (Aadhar, PAN, Voter ID, Driving Licence, Passport, etc.).
• Additional documents for address verification (ration card, vehicle registration certificates, rental agreements, bank statements, utility bills, etc.).

Professional Information:

• Previous employer details, roles, employee records, previous salary details, benefits, etc.
• Relevant documents for verification, including salary slips, experience certificates, relieving letters, appointment letters, etc.
• Professional reference checks upon customer request.

Education Information:

• University details, course information, department, etc.
• Verification through documents like degree certificates, consolidated mark sheets, or similar documents.

Criminal Background History:

• Details on any pending criminal complaints or related history.
• Verification of court records (civil and criminal) to identify any pending cases.
• Global Database check to determine associations with serious and organized crimes globally.

Credit Information:

• Credit score and credit history from relevant databases like CIBIL, EXPERIAN, EQUIFAX based on PAN information.

Sensitive Personal Information:

• Information dependent on the nature of the check requested by the Customer.
• If checks involve sensitive personal information, the Candidate will be informed, and specific consent will be obtained.
• This may include medical information about the Candidate.

Note: The collection and processing of each type of information are conducted with the utmost confidentiality and adherence to privacy standards. Any sensitive information will only be obtained with explicit consent from the Candidate.

In addition to the above, from the Customers, CredCheck Pro may collect the following information:

Signup Information for Services:

• Name: first name and last name
• Contact information: email address and telephone numbers
• User names (accounts alias) and passwords according to the product specifications to allow users to login and use the product
• Company/Organization name
• Company/Organization address

Billing and Payment Information:

• Credit Card number, Debit card number, billing address, and other relevant information to facilitate transactions between you and CredCheck Pro when make payment to us.

Usage Information:

• Time zone and date/time preferences for product usage
• IT information required to provide access to systems and networks, such as IP addresses, log files, login information, and encryption generation keys
• Information pertinent to fulfilling business transactions on a customer’s behalf, such as files uploaded by a user to a product for processing, system-generated emails, and meta-data like logs for usage information and activity logs

Analytics Information:

• Data collected from analytics tools like Google Analytics
• Analysis of data collected from candidate feedback during their Background Verification (BGV) process
• Analytics data collected when visiting our websites

Cookies:

• Cookies are small data files placed on your computer or mobile device when you visit a website, mobile app, or use an online platform.
• Cookies may be used by CredCheck Pro and its vendors for platform speed optimization and analytics purposes.
• Most browsers allow you to turn off cookies or receive a warning before a cookie is stored on your hard drive.

4. HOW DO WE COLLECT YOUR INFORMATION

Information Provided to Us:

• CredCheck Pro collects information directly when both the Customer or the Candidate submit information via our Platform, email, or any other means required to generate a background check report.
• This information may include personal details such as name, email address, or other relevant information needed to carry out our services.

Third-Party Information:

• To provide specific services and generate relevant background check reports, we may collect information from third parties with proper authorization.
• Third-party sources may encompass both private and public records, including:
  (a). Public Records: Information collected from government databases, court records, global databases, law enforcement agencies, or any publicly available records.
  (b). Private Records: With proper consent, CredCheck Pro may collect private records from educational institutions, employers, healthcare providers, and credit bureaus/agencies.

Automatically Collected Information:

• When Customers, Candidates, or any other individual visits our website or uses our services on our Platform, we automatically gather certain Internet or other electronic network activity information, including technical and usage information.
• This information, which may or may not be associated with your user account, assists in enhancing the performance of our systems.
• Automatically collected information is not shared with any third party.

5. WHO WE SHARE YOUR PERSONAL INFORMATION WITH

We share your Personal Information with a limited number of individuals/entities as mentioned below. We never share any Personal information with any other individual/entity/party that is not mentioned below. We share your Personal Information with:

Employees, Contractors, and Agents of CredCheck Pro:

• Individuals who require this information for performing their obligations and duties.
• Any Employee, Contractor, or Agent of CredCheck Pro with access to such Personal Information is obligated to maintain confidentiality and refrain from using it for any other purpose.

Sub-Contractors and Vendors:

• Sub-contractors and vendors contracted by CredCheck Pro to prepare verification reports.
• Personal Information of Candidates is shared with selected vendors and subcontractors on a “need-to-know” basis, adhering to industry standards and applicable data protection laws.

Customers and Candidates:

• We share the final background verification report with the Customer who requested such a report and the Candidate upon whom the report was requested.
• Exceptions to sharing with the Customer and Candidate are outlined in clause below.

Legal and Regulatory Compliance:

• Personal Information may be shared through the background verification report with state police, national investigation agencies, or third parties as directed by a competent Court order.
• A copy of the Candidate’s background verification report may be shared with relevant stakeholders in case of litigation (threatened or actual) to defend the rights of CredCheck Pro.

Explicit Consent:

• Apart from the above-mentioned categories, reports will not be shared with any other third party without explicit consent or a written request from you.

6. PURPOSES FOR WHICH WE COLLECT AND PROCESS PERSONAL INFORMATION

We only use Personal Information for the following purposes as mentioned below:

To Provide Services and Prepare Background Verification Reports:

• CredCheck Pro collects Personal Information, as mentioned under this Policy, to provide services to Customers by preparing background verification reports, offering analytics for such reports, and facilitating the functionality of our products.

Business Operations:

• Certain information, such as account details and billing information, is utilized for day-to-day business operations. This includes administering accounts, billing, managing our platform, and resolving errors or discrepancies that may arise on the Platform.

To Meet Legal and Compliance Requirements:

• Some collected information may be used by CredCheck Pro to (i) comply with applicable laws or regulations, (ii) assist state police or national investigation agencies in investigations as required by law or deemed necessary in good faith, (iii) protect the legal rights and legitimate interests of CredCheck Pro and Ishit Karoli, (iv) prevent fraud and abuse of CredCheck Pro’s services and Platform.

To Improve the Quality of Systems and Services:

• Collected Personal Information may be utilized by CredCheck Pro to enhance system functionality, conduct internal audits and checks, address problems, and maintain and improve the security and quality of our Services.

To Ensure Safety and Security:

• CredCheck Pro creates and maintains accounts on its Platform based on collected information. To verify existing information, prevent unauthorized or duplicate accounts, and mitigate fraud, CredCheck Pro may use the collected Personal Information.

7. PROCESSING OF PERSONAL INFORMATION

• CredCheck Pro, as a service provider and Platform, functions as a “Processor” of data. We will only collect information as per the sole instructions issued to us by our Customers from time to time and as agreed in our contractual agreements. This Privacy policy establishes the framework for processing any Personal Information. CredCheck Pro will process the Personal Information collected solely for the limited purposes mentioned in this Policy. The collected Personal Information will not be used for any other purpose.

We will implement technical, physical, and administrative measures against unauthorized processing of such information and against loss, destruction, or damage to Personal Information.

We do not own, control, or direct the use of Personal Information. All the Personal Information used to prepare the background verification report belongs solely to the Candidate. We access such information only as reasonably necessary and with the consent of the Candidate, to prepare background verification reports upon the request of our Customer.

• International Transfers

There is no direct international transfer of Personal Information on the CredCheck Pro India platform. However, some of our data is stored on our Cloud platform of AWS United States.

• Links to Third Party and Privacy Policy

Our Website may contain links to other websites that may collect Personal Information. CredCheck Pro and Ishit Karoli have no control or ownership of such websites and cannot guarantee the protection of your Personal Information on these websites. You are advised to read the Privacy Policy of such websites carefully and proceed at your own risk.

8. YOUR RIGHTS

You are entitled to certain rights with regard to your Personal Information and data. We make it our utmost priority to inform you and safeguard your rights. We respond to all requests in accordance with applicable data protection laws. If you have any queries, you can write to us at admin@credcheck.pro.

Both as a Customer and Candidate of SpringVerify, you have the following rights:

Right to Rectification:

• You can request the correction of any personal information we hold about you, enabling you to rectify any incorrect or inaccurate Personal Information. We may ask for relevant supporting documentation before making rectifications, considering the nature of the services.

Right to Withdraw Consent:

• You have the right to withdraw your consent for the collection and processing of your personal information. However, withdrawal of consent will immediately halt further progress in background verification. Candidates understand that the implications on potential or actual employment are beyond the scope of Credcheck Pro and Ishit Karoli, and you shall not hold us responsible for the same.

Right to Erasure of Personal Information:

• You can request the erasure of personal information we hold about you. If we don’t hear from the Customer within 90 days from the date of intimation about such a request, we will proceed to delete the data from our systems. However, erasure requests may be denied if it hampers legal rights in the future. Furthermore, Credcheck pro and Ishit Karoli has no control over data stored by third-party sources, subcontractors, and vendors used to generate background verification reports. To remove data from such sources, we request you to identify them, and we may, at our discretion, assist in identifying third-party holders of your Personal information.

Right to Request Access to Personal Information:

• You can request access to your Personal Information, entitling you to receive a copy of your data and check if it is processed lawfully as per this Policy and applicable laws.

Right to Restriction on Processing of Personal Information:

• You can object to or obtain a restriction on the processing of your Personal Information. However, this will stop CredCheck Pro from carrying out and preparing the background verification report.

Right to Portability:

• You have the right to portability, instructing us to transfer your Personal Information directly to you as per your request and instructions. Additionally:
• You have the right to complain to relevant authorities about our collection and processing of personal information.
• You can provide specific instructions for the use of your Personal Information after your death.
• For background checks involving Sensitive Personal Information, you can request specific details about the information collected.
• You have the right to opt-out of marketing communications or advertising.

We will not charge fees for exercising your rights unless requests are excessive, in which case we may charge for administrative purposes or reject excessive requests.

While you can complain to relevant authorities about our Data practices, we encourage you to first contact us with any questions or concerns. We respond to all requests in accordance with applicable data protection laws.

9. OUR POLICY TOWARD CHILDREN

CredCheck Pro or any aspect of its services is not intended for individuals under the age of 18. We do not knowingly collect personal information from individuals under 18 years old. In cases where a Customer wishes to conduct a background check on someone under the age of 18, they must obtain informed consent from the guardian of such individuals at their own cost and risk. Furthermore, individuals below the age of 13 are strictly prohibited from using our services.

If we become aware that a child under the age of 18, without the consent of their Parent/Guardian, or any child under the age of 13, has provided us with their Personal Information, we will take necessary steps to delete such information. CredCheck Pro will not assume any liability in such cases. If you become aware that a child has provided us with their Personal Information, please contact us using the details provided under the Contact Information section in this Policy.

10. SECURITY

Our company securely hosts your data using AWS cloud services, and your data is stored in the United States & India AWS Region. We are dedicated to ensuring the security of your information and have implemented robust technical, physical, and administrative procedures and protocols to safeguard and secure the data we collect. These measures are in place to prevent unauthorized access, modification, or disclosure.

If you wish, you can request us to provide you with a copy of these security policies for your reference. We prioritize the protection of your data and are committed to maintaining a secure environment for the information entrusted to us.

11. UPDATES TO THIS POLICY/NOTICE

CredCheck Pro reserves the right, at its discretion, to make changes to any part of the products, platforms, or this Policy. CredCheck Pro may alter this Policy periodically by updating this page. It is advisable to check this page regularly to stay informed about any changes. This Policy is effective from 09th December 2023. By continuing to use the products and services, you consent to this Policy as amended from time to time.

12. COMMUNICATIONS

If you are a Customer or a Candidate availing services of CredCheck Pro, we may need to communicate certain necessary information to you. This information might include product information, updates, or related announcements. For instance: Information regarding maintenance of any product or our website. We assure you that we will send these announcements only when they are necessary. Such communications are not marketing communications and you may not opt out of them. The only way to Opt-out of these is by deactivating your account.
